(EXCLUSIVE) Sandra Bland’s Mother Wants Jail Administrator Deposed In Wrongful Death Lawsuit
theJasmineBRAND.com exclusively reports, Sandra Bland’s mother has returned to court in her wrongful death lawsuit against Waller County, Texas – who she blames for her daughter’s death. She is accusing the defendants of refusing to allow her to depose a key person in the case – the jail administrator where Sandra died — and is pleading for the judge for help.
Here’s the latest: On August 10th, Bland’s family returned to court pleading with the judge for help — due to Waller County refusing to allow a key person – jail administrator Craig Davis – to be deposed by their lawyers.
The family explains the county has claimed Sandra died by way of a self-inflicted hanging and argue that she was depressed at the time she was booked and thereafter allegedly because her family refused to post her bail.
Back in 2010, the jail administrator, Craig Davis, issued a policy directive spelling out how detainees were to be addressed and handled at booking. The memo has been the subject of a significant amount of testimony offered by other defendants in the case. Therefore, they wish to depose Davis to grill him on the memo.
The family says the county originally said they would provide available dates for Davis to be deposed but now they are refusing to produce him without giving any reason.
They explain they can’t respond to the county’s motion for summary judgement – which they are asking to dismiss the case – until they have deposed the jail administrator.
The family is pleading for the judge to order Waller County to produce Davis to be deposed so they can grill him about the jail policies.
Here’s the backstory: Earlier this year, the family of Sandra Bland filed a wrongful death lawsuit against Waller County. The Texas Department of Public Safety, the state trooper who arrested her, Brian Encinia, and two jail employees.
A medical examiner listed suicide as the cause of death. However, the family disputes this and is suing for unspecified damages.
Bland was pulled over for a minor traffic violation back on July 10th 2015. The officer and Bland’s conversation quickly escalated and she was arrested due after he claimed she assaulted him.
The dash cam video of the arrest went viral and caused an uproar over the treatment she received by police and jail officials — with many disputing the arrest and eventually death of Bland while in the Waller County Jail. 3 days after her arrest, Bland was found hanged in her jail cell. The coroner listed the cause of death as suicide.
However, many have disputed the facts of the case, the official cause of death and accused police and jail officials of racial violence. Following the protests, the F.B.I. and Texas authorities launched an official investigation into the case.
Last year, a grand jury declined to issue an indictment in relation to Bland’s death. However, the arresting officer was indicted for perjury.
The family’s wrongful death lawsuit is currently in the discovery phase with both sides exchanging documents, information and taking depositions of key people. The trial is scheduled to begin next year.
The family of Sandra Bland are demanding Waller County, Texas be shut down in their attempt to keep information and documents from the public.
