Don Lemon Now Allowed To Pursue Fraud & Contract Claims Against Elon Musk’s X Over Abruptly Canceled $1.5 Million Content Deal
A San Francisco judge ruled that Don Lemon can move forward with parts of his lawsuit against Elon Musk and X. The court allowed claims of fraud, misappropriation of likeness, breach of implied contract, promissory estoppel, and unjust enrichment. However, it dismissed others including defamation and harassment.
Lemon sued after Musk abruptly ended a planned exclusive content deal following their tense March 8 interview. Musk texted Lemon’s agent, “contract is canceled.” Lemon’s attorney, Carney Shegerian, said, “The ruling means Don can hold X and Musk accountable in open court. Musk is subject to the legal process, just like everyone else.”
According to the complaint, X had promised Lemon $1.5 million and ad revenue shares for weekly and monthly video content. Lemon claims he was pressured to announce the deal early for advertiser appeal, only to be told afterward that no payment would be made because nothing was signed.
The case will proceed in California, not Texas, as Musk requested.
