We now have more insight into the arguments #ToryLanez raised in his denied appeal.

Court documents obtained by legal affairs journalist Meghann Cuniff reveal that the Brampton, Canada native did not dispute the judge’s conclusion that his “post-incident conduct” was a “major factor in aggravation in this case.” As previously reported, #MeganTheeStallion, real name Megan Pete, accused Tory of continuing to harass her after the 2020 sh**ting while the case worked its way through court.

One point Tory, real name Daystar Peterson, did push back on, however, was the judge’s “vulnerable victim” finding. The legal filing references Megan’s former best friend, Kelsey Harris (aka #KelseyNicole), who witnessed the shooting, and notes: “The only one of these findings Peterson challenges on appeal is the “vulnerable victim” finding. Referring to Harris’s statement to prosecutors that “she saw Peterson reach towards the center console after threatening to sh**t her,” Peterson contends Pete should have recognized “there were indeed signs that an armed individual may be in the vehicle” and “thus had the ability to run or duck once she saw a g*n being pointed at her.

Tory’s appeal was denied on Wednesday (Nov. 13) by the California Court of Appeals, affirming that both his convictions and 10-year sentence will remain in place.
