After Attendee Claims He Was Used As Unpaid ‘Background Talent’ At Packed Auditions
A New Jersey man is taking Kai Cenat’s company and management firm to federal court, claiming a packed Streamer University audition turned him into unpaid promotional material and endangered his health.
Caleb Gottfried filed the lawsuit June 26 in federal court against Kai Cenat LLC and Night Media, Inc. The self-represented plaintiff says he attended the June 12 audition at John Jay College of Criminal Justice without expecting to appear in commercial content.
Gottfried alleges cameras captured him in HD and used his likeness as “background talent” to make the gathering look crowded. He claims nobody provided a model release or publicity waiver and says unreleased raw footage, including an alleged audition recording, remains in the defendants’ possession.
The complaint also accuses organizers of placing attendees inside a poorly ventilated, enclosed space without sufficient crowd control. Gottfried says he experienced two near-heat stroke incidents while NYPD officers were present and witnessed his distress.
He seeks $330,000 in compensatory damages, punitive damages and deletion of recordings depicting him. The lawsuit asserts unauthorized use of likeness and gross negligence. Kai Cenat LLC was served July 16 and must respond by August 6.
