Under the direction of Judge Christine Mulleneaux, Earl Simmons (better known as DMX), who has been imprison since December 16 for violating probation, has been moved from prison to a mental health unit. Mulleneaux suggests that he has an undiagnosed personality disorder and is possibly bipolar.

X has been sentenced for one year, but his wife Tashera Simmons, suggests that his recent encounter with the law (violating probation) is because X was set up. She told a local radio station:
“I’m telling you the real now, I told Earl, ‘You need to get out of Arizona. They do not like you there.’ The thing is his probation was up in three weeks, and they said he could not leave until it was up. They let him do shows but he couldn’t actually move out of Arizona until his probation was up…but he only had three weeks left. They set him up. You see that he was in a rehab [center] that they put him in because he was dropping dirty and they gave him permission to go and do a show. How are you giving someone that’s supposed to be in a rehab permission to do a show? That’s like a set up. And X, I can’t believe that he even took a drink knowing the situation.”
