[EXCLUSIVE] Ex-American Idol Contestant Corey Clark Continues Battle Over Paula Abdul Affair Story
The broadcast touched upon his disqualification from the show and his alleged affair with Abdul, including her denial of any affair along with the fact that FOX hired an independent law firm to investigation the claims — who found no evidence to back up the affair. He claimed that the show damaged his reputation, character and integrity in the community and hindered his opportunity for future potential income.
The network fired back at him claiming they only recounted things that Clark had admitted in the past about him and Abdul. They also argued that his lawsuit was filed way past the statue of limitations in Tennessee, which says such a lawsuit has to be filed within six months of the words being uttered that one believes are defaming.
Following the court order in June, Clark filed docs attempting to vacate the judges decision and the federal court judge sided with the ex-American Idol contestant.
Clark argued that since the E! True Hollywood Story episode aired numerous times following the original broadcast that he had filed within the statue of limitations since the last airing of the episode in question. The court agreed and ordered the original decision be vacated. However, the judge threw out the defamation claim but he is allowing Clark to continue on with the false light claim of his lawsuit against the network.
The judge states that Clark may have a case for false light … which he explains means,
The facts may be true in a false light claim. However, the angle from which the facts are presented, or the omission of certain material facts, results in placing the plaintiff in a false light.
The order notes,
When the facts are construed in a light most favorable to Plaintiff, one conclusion that can be drawn from the Program is that E! intentionally chose to present the information in such a way as to infer that Plaintiff made up the affair, and also that he did so in an effort to advance his career at the expense of Ms. Abdul’s.
Clark’s scored a legal victory with the decision and can continue his million dollar legal battle.
