Bow Wow Fined By Judge in Porn Star Lawsuit
theJasmineBRAND.com exclusively reports, Bow Wow (real name Shad Moss) has been slapped with a $7,000 fine for refusing to hand over documents in his porn star legal battle, with the judge warning that he will impose even more drastic sanctions against the rapper in the case.
Here’s the latest: On December 9th, a hearing was held in the case on Celine Tran’s motion to force the rapper/actor to hand over the documents she requested and for him to be sanctioned for not following the court rules.
The judge ordered that Bow will have to pay a total of $7,065 in sanctions to the plaintiff for his refusal to hand over all documents to her in the case. He will have to pay by January 9th.
He warns the rapper that failure to pay the sanctions on time will result in drastic sanctions, including, without limitation, the judge ordering Bow in default and allow the plaintiff to move for a default judgement against him once again.
Further, the order states Bow Wow’s lawyer will have to pay a sanctions to the Attorney Admission Fund for failure to comply with the court order.
Here’s the backstory: Back in 2013, adult film star Celine Tran (aka “Katsuni”) sued the rapper/actor, accusing him of taking clips of her pole dancing and using them in the music video for “Drank in My Cup”. The porn actress claimed Bow Wow never got her permission to use her footage or likeness in the music video.
The rapper was hit with a default judgement – due to him never showing up to court – in the amount of $79,346.07 for damages and the porn star’s attorney fees.
Back in January, Bow Wow went to federal court and demanded the default judgement be vacated along with all collection efforts by Tran. The rapper explained that the porn star claimed to have served him with the legal documents at an address he didn’t live at back in 2012. He claimed he wasn’t even in the country at the time Tran said he was served and the address she listed is where his mom lives.
Bow Wow said the adult film star has been attempting to collect on her $80k judgement by coming after his company Faze 2 Entertainment in Georgia court. However, he claimed that she obtained the judgement without properly serving him and thus the judgement should be void.
The rapper demanded the federal court judge throw out the $80k default judgement and order the woman to cease attempting to collect on the money until he can respond to her original lawsuit allegations. Tran responded, claiming he was fully aware of the legal battle and she said he was served properly with the documents.
However, the judge came back shortly after and sided with the rapper. The decision vacated the original judgement of $80k and ordered the original lawsuit to be re-opened.
Then in June, Bow Wow finally went to court and responded to the allegations in the original complaint filed by the porn star. He says that he did nothing wrong and if any footage was used without her consent it’s not his fault, but the blame is solely on third parties who didn’t get clearance or it was simply an error.
Bow Wow claimed the porn star didn’t suffer any damages as a result of being in his music video. He adds that he did not have actual knowledge of any alleged unauthorized use of the woman’s likeness. He stated that if any use of the porn star’s likeness or image was incidental, trivial or fleeting … aka … if her face was shown in the video … it was for a short amount of time and it wasn’t the focus on the video whatsoever. The rapper demanded the entire case be thrown out.
The two parties have been battling it out in court for months with Tran accusing Bow Wow of refusing to hand over documents/information & attempting to delay the case by having his lawyer withdraw from the case.
