Gabrielle Union Allegedly Preparing To Sue Simon Cowell Amid ‘AGT’ Drama, Believes ‘His Smoking Put Her At Risk’

Despite firing her roughly three months ago, “America’s Got Talent’ hasn’t seen the last of former judge Gabrielle Union. 

The actress, who was fired in November amid reportedly being told her hairstyles were “too black,” is said to be gearing up for a lawsuit against judge and executive producer Simon Cowell, according to reports.

Before her departure, she also reportedly spoke up against a “toxic” work environment that included Simon Cowell allegedly smoking on the set. That’s said to be the source of her lawsuit.

A source told the site,

“Gabrielle was always cross that Simon would smoke when the cameras weren’t running.”

They said she believes Simon Cowell’s alleged smoking put her health at risk.

“For her, this is a big deal. She believes his smoking has put her life in danger. It can cause cancer and she doesn’t think she deserves to have been at risk when she was at work. This lawsuit will be sent to Simon at any moment. She is determined to see this one through.”

It was previously reported that she already hired high-power attorney Bryan Freedman shortly after being fired.

She could have a case as The Daily Mail reports California has a law that makes it illegal for employers to

“knowingly or intentionally permitting… the smoking of tobacco products in an enclosed place of employment.”

This isn’t the first time Gabrielle Union is said to be taking legal action.

Back in November, it was reported that she was thinking about suing. Those reports also said that Gabrielle Union took issue with Simon Cowell smoking indoors, but was often allegedly viewed as “difficult” when she spoke up about it.

Simon Cowell’s production company, which serves as an “AGT” producer broke its silence about the controversial firing in December.

It said in a statement,

“We are working with Ms. Union through her representatives to hear more about her concerns, following which we will take whatever next steps may be appropriate.”
