Demi Lovato Responds To Lawsuit

theJasmineBRAND.com exclusively reports, Demi Lovato is firing back at the hit indie band accusing her of ripping off their music, with the pop star demanding the lawsuit be thrown out of court — due to her claiming she is completely innocent and never intentionally stole from the group.

Here’s the latest: On November 18th, Demi headed to court, blasting Sleigh Bells for the allegations she ripped off their work. The singer demands the entire lawsuit be thrown out of court because she wasn’t responsible for creating the portion of the song the band claims is infringing.

Demi says if any portion of the track was used, it was done legally and falls under fair use. She argues if the band is awarded any judgement, the judge should not order her to pay any portion because she was innocent and without notice of knowledge of Sleigh Bell’s rights. The pop star is also seeking to have her attorney fees covered by the plaintiff.

Here’s the backstory: The band members of group “Sleigh Bells” Derek E. Miller and Sydney Alexis Krauss filed a federal lawsuit against the singer, Universal Music Group and Island Records.

The band accused Demi of ripping off their original song, “Infinity Guitars” and using it in her song “Stars”, which is featured on her recently released album “Confident” — without ever asking for permission.

Sleigh Bells has released 3 albums since 2008, which have been licensed for everything from various television show episodes, commercials and films.

They released the song “Infinity Guitars” as part of their debut album entitled “Treats” back in 2010. The members accuse Demi of ripping off compositional elements in their song including the combination of the hand claps and bass drum, structured as 3 quarter beats and a rest, with the bass drum providing a counter-rhythm to the hand claps, is at least substantially similar in both works.

Further, they believe Demi or the label execs heard their song since it was popular when released. Sleigh Bells claimed Demi and Universal Music profited substantially off the infringing song “Stars” through sales of digital downloads, licensing and other record sales. They accuse the singer of causing them lost profits, lost opportunities and loss of goodwill.

The band sued demanding $150k per infringement by Demi and unspecified damages for the illegally use of their work along with an injunction prohibiting the pop star from continuing to sell the song.
