Nipsey Hussle’s Alleged Shooter Eric Holder Wants Related Attempted Murder Charges Dismissed, Pleads Not Guilty For All Charges
The case against Eric Holder, the man accused of shooting and killing rapper Nipsey Hussle, is moving along slowly but surely.
Eric Holder, 33, has been charged for one count of murder, two counts of attempted murder, two counts of assault with a deadly weapon, and a felony in possession of a firearm. His legal team has since filed a motion to dismiss the attempted murder counts.
As previously reported, Eric Holder and Nipsey Hussle allegedly had a conversation outside of his The Marathon Store in Crenshaw on March 31. Hussle reportedly accused Holder of being a snitch before Holder allegedly went to go grab a gun from a nearby car and opened fire, shooting and killing Hussle, and injuring two bystanders.
According to reports, he has asked the court to toss out the attempted murder charges, which are based on a theory called “Kill Zone.” In order to prove the Kill Zone theory, one must show there was a key target, what type of weapon was used, how far the shooter and the victim were, as well as how far other victims were from the shooter. Other factors like whether the targets were in a closed-off area and whether the target was moving during the alleged attack also have to be proven.
Court documents say that the state of California is convinced that in this case, each of these factors have been checked, so the “kill zone” theory should apply.
Deputy District Attorney John McKinney also suggested that Holder keeps stalling the case.
“Every defendant in California has a right to a speedy trial, that’s a right to go to trial within 60 days of their arraignment. We are well past 60 days because he keeps waiving his right. Given the magnitude of the case, the complexities of the case, work his defense attorney needs to do, he knew it wasn’t in his best interest to try to go to trial right now.”
Holder pleaded not guilty when he was indicted back in May.
He was arrested two days after the tragic death of Hussle. Hussle was 33-years-old.
