(EXCLUSIVE) Derrick Rose Allegedly Cheated On SAT, Doesn’t Want Scandal Included In Rape Trial
theJasmineBRAND.com exclusively reports, Derrick Rose is demanding his rape accuser not be allowed to present evidence of his NCAA scandal – in which he was accused of cheating on his SAT test prior to being admitted into the University of Memphis – during the upcoming court trial. He claims the information is irrelevant and will prejudice him with the jury.
Here’s the latest: On September 8th, Rose filed docs explaining his accuser is trying to introduce witnesses related to his NCAA University scandal in the upcoming trial. The woman informed the court she plans to call the custodian of records of NCAA – to give testimony of the NCAA University of Memphis public infractions report from 2009 and his failure to respond and the penalties that were imposed, along with the custodian of records of Educational Testing Service in relation to allegations Rose cheated on standardized college entrance examination and his failure to respond.
Further, she plans to show the jury the lease of Rose’s Beverly Hills residence and lease of his luxury car. He believes this is to show the jury members evidence of his wealth.
Rose says the situation from his teenage years is irrelevant and far removed from the issues of this case. He believes it will unfairly prejudice him during the trial if she’s allowed to introduce the irrelevant information in the case.
He says that the University of Memphis scandal was during the 2007-08 academic year, while he was in college. His team argues,
Such nine-year-old evidence about a nonprofit association’s investigations into alleged violations of its rules governing collegiate athletic eligibility for student-athletes is irrelevant as it is far removed in subject matter and time period from any issue in this case and will only unfairly prejudice Mr. Rose, confuse the issues, mislead the jury, result in undue delay, waste time, and needlessly present cumulative evidence.
Rose was accused of having another person take his SAT test to be eligible to play at the University. He reportedly failed the ACT on 3 occasions in Chicago but his SAT was taken in Detroit. He denied any wrongdoing and claimed to have taken the test himself.
As a result, the University of Memphis had to return money it received from the NCAA tournament, also had to return the trophy and vacate all 38 wins they won during the 2007-2008 season.
Here’s the backstory: Rose was sued earlier this year by a woman – who filed the complaint under Jane Joe – accusing the NBA star and two of his friends of drugging her and then gang raping her inside her apartment.
The woman explained she dated Rose from 2011 to 2013 and during the time she said Rose attempted to pressure her into doing various sexual activities such as masturbating on camera, allowing him to have sex with her friends and demanding she participate in group sex.
Back in August 2013, the woman claimed that Rose and his two friends, Ryan Allen and Randall Hampton, invited her to the NBA star’s L.A. mansion, where she claims someone slipped a drug into her drink with the aim of raping her.
She claimed that she escaped the home with a friend but later in the evening Rose and his friends broke into her home and gang raped her while she was unconscious. The woman filed suit and is demanding 21 million dollars in damages.
The NBA star responded, denying all allegations that he raped his ex-girlfriend and said she gave him and his friends consent to have sex. Rose claimed that the woman was only upset with him due to her not being reimbursed for sex toys used during the night in question. He said that once he started ignoring her texts, she became even angrier with him. Rose demanded the entire suit be thrown out. The suit is in the discovery phase with both parties taking depositions and exchanging documents preparing for the upcoming trial later this year.
