EXCLUSIVE: Tank Sued By Music Producer
theJasmineBRAND exclusively reports, Tank (real name Durrell Babbs ) is accused of stealing a music producers original work and passing it off as his own, and now he’s been hit with a federal lawsuit.
Kerry Marshall (aka Kerry 2Smooth) filed suit against Tank, Johnnie Newt (aka J. Valentine) and Atlantic Records. In the court docs, Marshall explains Tank recently released an album “Savage”, which contains a song entitled “Only One”.
The docs explain that he is a guitarist, producer, artist developer and member of the recording academy. Currently, he is the lead guitarist for the Black Eyed Peas and other singers. The docs also note that he has a popular YouTube channel with a catalogue of instructional videos. One of his videos which contained original music, which he says he had copyrighted.
In the lawsuit, Marshall accuses Tank of using portions of his original track in his song “Only One”, saying he copied key structural elements, themes and motifs from his song.

In the docs, Marshall says Tank nor any other parties sought permission to use his work nor has he been paid. Marshall is suing for an injunction against Tank from being able to continue to distribute and profit off the alleged infringing song, $150k in damages per infringement and attorney fees.
