Kevin Hart Wants $60 Million Sex Tape Lawsuit Dismissed, Says Montia Sabbag’s Claims Are Past The Statute of Limitations

Comedic actor Kevin Hart made a second attempt to have a multi-million dollar sex tape lawsuit against him tossed out of court. He has reportedly requested that the $60 million lawsuit filed in 2019 by the woman featured in the video, Montia Sabbag, be dismissed once and for all. This isn’t the first time, though, that issues seemed to exist with the lawsuit filings. When she first filed the paperwork, she did so in the wrong jurisdiction and the case was dismissed with the understanding that if she filed in the correct venue, the paperwork would be accepted.

While the filing was done properly the second time, Kevin Hart says a judge should dismiss the case altogether, arguing that Montia Sabbag filed most of her claims beyond the statute of limitations for them. Kevin Hart also solicited for the lawsuit to be dismissed when he alleged he was not served properly according to photos and says the individual,

“simply threw a set of papers out of a car window in view of a security guard.”

In her original complaint, Montia Sabbag accused Kevin of conspiring with his now former friend Jonathan “JT” Jackson to secretly film their sexual encounter in Las Vegas and then leak it to promote an upcoming tour. At the time, Kevin Hart claimed that he too was a victim of Jonathan Jackson‘s alleged blackmail attempts, who was reportedly a friend of the Jumanji: The Next Level actor for 15 years. Jonathan Jackson was arrested on extortion charges, but they were dismissed in September 2019 because, reportedly, there were never any demands made for money from Kevin, and Jonathan Jackson has maintained that he believed he was “framed.”

Although Kevin has admitted to cheating on his wife Eniko Hart (who, during the time of the encounter between him and Montia, was pregnant with their now 2-year-old son Kenzo) and has publicly apologized for doing so, he has always said he had no knowledge of the recording. The now-infamous extramarital affair took center stage during Kevin‘s six-part Netflix documentary entitled “Kevin Hart: Don’t F**k This Up” where Eniko Hart, who is currently pregnant with her’s and Kevin’s second child, can be heard saying how she was “publicly humiliated” as a result of the occurrence.
