Attorney Mark Geragos believes Diddy may not be behind bars for much longer.

I think there’s a potential there,” the high-profile defense attorney said when asked about the possibility of Diddy securing an immediate release as his legal team presses forward with a major federal appeal.

Diddy is currently asking the 2nd U.S. Circuit Court of Appeals in Manhattan to overturn his pr*stitution-related convictions or reduce the four-year-and-two-month prison sentence he is serving.

His attorneys argue that the judge who sentenced him improperly relied on evidence connected to charges he had already been acquitted of — a move they say unfairly increased his punishment.

At issue are two Mann Act violations that did not require proof of force, fraud, or coercion. Despite being cleared of more serious counts that carried potential life sentences and massive financial forfeitures, Combs’ defense says Judge Arun Subramanian still allowed those rejected allegations to influence the final sentencing decision.

The defense is now asking the appellate court to vacate the convictions, order Combs’ immediate release, or send the case back for resentencing.

Geragos maintains the outcome was unjust.

Remember, when he was convicted of these two Mann Act violations … he won against the counts that carried a mandatory life sentence and would have basically forfeited his entire fortune. So, he rolled the dice and won, and then he was enhanced in his sentence by the very conduct he was acquitted of.

“I think that’s fundamentally unfair. In fact, we want to talk about fairness. I think the prosecution should be penalized for overcharging him in the first place, and he should have been immediately released. That’s just me. I have great affection, and I think that’s the just result.”
