Jussie Smollett Sues Chicago, Police Department & The 2 Brothers Who Claimed They Were Paid To Stage Attack On Him
Jussie Smollett is taking legal action against the City of Chicago.
While the city has sued for six figures, alleging that Jussie Smollett is responsible for the cost of the investigation into his claims that he was the victim of a racial and homophobic attack in January, Jussie Smollett has now accused the city of malicious prosecution in his counterclaim. He also named the Chicago Police Department, Detectives Michael Theis and Edward Wodnicki along with Supt. Eddie Johnson in the lawsuit. Interestingly enough, he’s also suing the two people who were accused of the attack, Nigerian brothers Abimbola and Olabinjo Osundairo. At one point, the brothers claimed that Smollett paid them to attack him.
His lawyers claim the city can’t legally be reimbursed for the $130,106 cost of the investigation because it has already received $10,000 from Smollett, which was considered “payment in full.”
In his 49-page lawsuit filed Tuesday (Nov. 19), he said the city’s alleged malicious prosecution that resulted in
“humiliation, mental anguish and extreme emotional distress.”
It also points that the charges against Smollett for allegations of filing a police report were dropped
“in Mr. Smollett’s favor and in a manner which indicates his innocence because all 16 counts of the criminal indictment were dismissed two and a half weeks after the indictment was filed.”
The counterclaim comes after a U.S. District Judge refused to dismiss the city’s case against Smollett, stating,
“the city must prove the truth of these allegations to prevail at summary judgment or trial, at which point Smollett will be free to dispute the city’s claims.”
Smollett became a topic of conversation after he said he was the victim of an attack. Things went left after the Osundairo brothers came forward and said Smollett paid them. There was speculation that he staged the attack because he was unhappy with his salary on Fox’s “Empire.” He has since been fired from the series, which is currently in its last season.
