Donald Trump Temporarily Keeps Control Of California National Guard After Judge Blocks Use Of Troops For ICE Support
A federal appeals court is allowing Trump to keep control of California’s National Guard, for now. This decision comes after a lower court said he overstepped his authority.

According to U.S. District Judge Charles Breyer, Trump violated the Constitution by deploying 4,000 Guard troops to assist ICE operations without the governor’s approval. The judge ordered the troops returned to California’s control.

Governor Gavin Newsom challenged the original deployment, calling it an abuse of power. The judge agreed, stating it did not meet the legal threshold for a rebellion or national emergency.

However, the Ninth Circuit Court of Appeals paused that ruling. According to the court, the federal government will retain control while the case moves forward.

This is the first time in decades that a president has taken control of a state’s National Guard without the governor’s consent. A full hearing is scheduled for June 17.
