[EXCLUSIVE] NBA Baller Trey Burke: I Had No Idea Man in Selfie Had Medical Disorder
Then on September 12th, Trey filed his response to the legal action asking the court to dismiss the lawsuit completely.
He explains that him and his team mate Ian Clarke have a locker room relationship and often mock each other on social media.
Burke claims that he saw the original posting of the selfie on Waka’s instagram. He then explains he re-posted the photo with the caption pretending to have been hacked by Clarke — it is common for people to post selfies of themselves when they hack a friends Instagram.
He explains he thought the photo had been photoshopped and didn’t know it was a real person. He says he didn’t learn about Binion’s medical issue until the media reports. He says he never made mean comments about the man or his condition, and once he found out the man had the rare disorder he removed the photo from his Instagram.
Burke says he then offered to host Binion at a Detroit Pistons/Utah Jazz game , which the man said he would most likely take him up on the offer. Burke also points out that the man gave a interview where he said he accepted Burke’s apology.
He is asking the court to dismiss the lawsuit, citing the user agreement on Instagram which states that if a profile is made public all members and that anyone can share the content they post and also that he didn’t make any comments about the mans condition since he didn’t know about it.
