EXCLUSIVE: Omar Epps Wants Lawsuit Accusing Him Of Breaking Actress Arm Dismissed
theJasmineBRAND exclusively reports, Omar Epps is responding to a 59-year-old actress that is suing him for assault and battery. Epps wants the entire case dismissed.
Here’s the backstory: As previously reported, actress Donzaleigh Abernathy sued Epps and Paramount Pictures over an incident that went down on the set of the USA show “Shooter”. In the suit, she says May 2016, Epps improvised a scene during filming where his character was going to murder her character. The 59-year-old actress says that in the scene and he
threw his left forearm with full force at [her] right arm.
She says that the scene resulted in her arm being broken and hospitalization. Abernathy accused Epps of being negligent and reckless during filming. She said along with the broken arm injury, during the scene, he dropped her during on the floor leading to back injuries. The suit alleged that production had to stop, and she was sent to the hospital. The suit alleges assault and battery. She is seeking unspecified damages.
Here’s the latest: On April 11, Epps and Paramount Pictures filed docs responding to the suit. Epps argues Paramount was Abernathy’s employer and any alleged injuries should be paid out by worker’s compensation.
The actor says the actress failed to minimize or prevent any damages she claims to have suffered. Further, he accuses her of failing to exercise ordinary care on her own behalf in connection with the
incident.
Epps is demanding the entire lawsuit be thrown out.
