Kanye Fires Divorce Attorney, Is Expected To Challenge Kim Kardashian Prenup

New reports continue to surface concerning Kanye West and Kim Kardashian’s divorce proceedings. According to Radar Online, the rap star fired his attorney, Chris Melcher, due to communication issues.

He is said to have hired Dr. Dre’s lawyer Samantha Spector. As you’ll recall, Dr. Dre’s case resulted in the music mogul paying $100 million to avoid a costly trial.

The estranged couple are set to appear in court today Wednesday (Mar.2). Kanye West, 44, is reportedly challenging his prenuptial agreement with Kim Kardashian, 41, in an apparent attempt to dismiss her efforts to have herself declared single. According to reports, the Chicago rapper’s lawyers have filed legal documents arguing that all prenuptial agreements signed in California after 2002 are presumed to be invalid. Ye’s lawyers said,

“California premarital agreements entered on or after January 1, 2002, are presumptively invalid. The presumption of invalidity exists until rebutted at trial or the parties ratify the agreement. We are in the early stages of the case so no ratification has occurred.”

This is a little odd since Kanye West has never claimed that his prenup agreement with Kim Kardashian is invalid. In fact, their prenup kept almost all their property separate during their marriage. Nonetheless, Kanye’s claims appear to be false. Reportedly, California’s law requires one of the spouses to challenge the prenuptial agreement for it to be presumed invalid, in which Ye has not done so yet.

If he were to do so, he would need to prove that the agreement was ‘unconscionable,’ meaning that it was too one-sided, or that either party didn’t agree to it voluntarily. According to sources, Kanye had a lawyer representing him when he signed the prenuptial agreement, suggesting that his signature wasn’t involuntary.

This news comes just days after Kim Kardashian filed court documents claiming that the “Junya” rappers recent social media posts have been filled with ‘misinformation,’ and she claimed his attacks on her and her boyfriend Pete Davidson have caused her ’emotional distress.’

Reportedly, in court documents the SKIMS owner states,

“I very much desire to be divorced.”

Kim Kardashian continues and shares that she has asked Kanye West to keep their divorce proceedings private,

“but he has not done so.”

She adds,

“Kanye has been putting a lot of misinformation regarding our private matters and co-parenting on social media which has created emotional distress.”

Kim Kardashian is reportedly, using her estranged husband’s social media posts as an argument for granting her a single status, but West’s attorneys said she would need to prove he had personally written the posts. From the looks of it, it won’t be hard to prove seeing that Kanye West recently spoke out claiming that his Instagram has not been hacked, showing that he is indeed the one making the post or at least is giving approval for the posts being made on his page.

In legal docs, Kanye’s lawyers wrote,

“Kim claims she read something online allegedly by Kanye and characterizes the posts in her declaration as misinformation. The social media posts are not attached to the declaration. Kim needed to offer the social media posts into evidence, and show that the posts were written by Kanye.”

From the looks of it, this court hearing will be very interesting to say the least.
