Reality TV stars Gizelle Bryant and Robyn Dixon are not backing away from their legal battle.
After rap star Eminem opposed the entertainers’ attempt to trademark their podcast name “Reasonably Shady,” Gizelle Bryant and Robyn Dixon reportedly have submitted a court rebuttal.
According to a report from Radar Online, the Potomac residents recently filed a motion, opposing Eminem’s original opposition. As we previously reported, the reality TV cast members filed the trademark in order to sell merch associated with their online platform. That was until the Detroit rapper, real name Marshall Mathers, opposed their application.
Reportedly, the musician believes the podcast name is too similar to his alternate stage name Slim Shady. Eminem regularly went by the name at the start of his career and trademarked it after gaining commercial success. In the most recent court filing, Gizelle Bryant and Robyn Dixon disputed the opposition. Denying the two names are confusingly similar, Bryant and Dixon reportedly asked a judge to toss Eminem’s motion altogether.
Reportedly in the court docs, the women denied knowing of Eminem’s rights to Shady, which include the “names and marks Slim Shady, Shady and Shady Limited.” Additionally, Bryant and Dixon disputed allegations that “Reasonably Shady” is identical to Slim Shady and would confuse consumers. They reportedly added the name also does not suggest the rapper is tied to the project and asked the US Patent and Trademark Office to reject Eminem’s motion and sign off on their application.
In his original opposition, Eminem highlighted his trademarks, which include exclusive ownership of Slim Shady. The 15-time Grammy award winner reportedly also owns the legal registration for ‘Shady’ in Class 025, which granted him official usage of the term for a variety of apparel. Additionally, Eminem reportedly noted the podcast name could “affect the distinctive quality” of his Slim Shady brand by leading consumers to believe he’s associated.
Eminem has reportedly not responded to the new motion at this time.
