Kim Zolciak & Kroy Biermann Emotionally Plead w/ Court To Stop Auction On Their Mansion: ‘Our Children Would Be Left Homeless’
Estranged couple Kim Zolciak & Kroy Biermann aren’t letting go of their home without a fight.
The “RHOA” alums recently submitted an official court injunction in an effort to stop the foreclosure of their Georgia residence.
According to a recent report from RadarOnline, Kim Zolciak and Kroy Biermann filed legal papers asking the court to block Truist Bank from putting the 7-bedroom, 9-bathroom property up for auction. Reportedly, the home is set to be foreclosed on the 7th of next month, but the couple is seeking a temporary restraining order against the bank in the meantime. In a formal complaint, they reportedly argued that Truist has “initiated a nonjudicial foreclosure proceeding,” citing they’ve recently listed the home for $6 million and need time for it to sell.
Additionally, they reportedly wrote that they are still in the midst of dividing assets in their divorce settlement, and their home is the only thing of significant value they both have. In the legal document, Zolciak and Biermann reportedly claimed that in losing the home, they’ll suffer:
“immediate and irreparable injury in that to allow defendant to continue with the foreclosure would thwart the spirit and intention of the Order issued in the divorce case in order to preserve the marital estate.”
Specifically, Kim added her own emotional reasons for retaining ownership of the home, adding:
“Our primary concern revolves around the home that we share, in which we have invested not only our finances but also our memories….we strongly believe that the proceeds from its sale can help alleviate our financial difficulties and secure a stable future for our children,”
And continued that should they lose the home:
“Kroy and I will face insurmountable financial hardships, and the most devastating consequence will be the impact on our children, who would be left homeless.”
Zolciak and Biermann’s financial woes have only seemed to worsen as time goes on. Along with their struggles to keep their house, the couple also reportedly face IRS debt, gambling debt, and credit card debt. Some reports state that their long-standing money problems were ultimately the catalyst for the divorce, though neither have confirmed this.
A judge has not ruled on the matter at this time.
