Bill Cosby’s Criminal Sexual Assault Case Prosecutor Requests Supreme Court Revive The Case

The golden years have been mighty gray for America’s former father figure. It’s being reported that prosecutors have initiated a bid to revive the criminal sex assault case against Bill Cosby. A lawyer for Bill Cosby is asking the U.S. Supreme Court to reject the bid. The aging actor found freedom last June when his conviction was overturned through a Pennsylvania appeals court after almost three years of time served.

In the midst of charges brought about in 2005, Bill Cosby delivered an incriminating testimony that resulted in his arrest in 2015. The court reportedly learned later that Cosby was under the impression that he was protected by a non prosecution agreement supported by Bruce Castor, the former district attorney, at the time. According to reports, however, the promise of protection was not found in writing. There was a news release in 2005 in which Bruce Castor stated that he did not have sufficient evidence to arrest Cosby, but current Pennsylvania District Attorney, Kevin Steele, does not acknowledge the statement as a non prosecution promise.

 

 

Cosby’s legal team reportedly submitted a 15 page response filed with the court on Monday. Jennifer Bonjean, a lawyer for Bill Cosby, claims that reviving the case should be of no interest to the court, stating that the case rests on a narrow set of facts. In the response, Jennifer Bonjean wrote:

“Notwithstanding the commonwealth’s warning of imminent catastrophic consequences, the Cosby holding will likely be confined to its own rare, if not entirely unique, set of circumstances, making review by this court particularly unjustified.”

In order for a case like this to be revived in the U.S. Supreme Court, four out of nine justices of the court must be willing to hear the case. Statistics may be on Cosby’s side as it has been reported that the Supreme Court typically accepts less than 1% of it’s petitions received. According to reports, two of the court’s justices, Brett Kavanaugh and Clarence Thomas also faced accusations of sexual misconduct during confirmatin hearings in the past.
