Dave Chappelle Is Not Happy The DA Won’t Charge Attacker With Felony, His Attorney Says ‘It’a A Travesty Of Justice’ + Judge Refuses to Reduce $30,000 Bail

Dave Chappelle is not pleased with Los Angeles County District Attorney George Gascón’s decision to not charge Isaiah Lee with a Felony.

Dave Chappelle’s attorney– Gabriel Colwell– had this to say about the DA’s shocking decision:

“It’s a travesty of justice that Gascón is refusing to prosecute this case as a felony. The city attorney, who filed the case, is doing his job but DA Gascón should also do his job and charge this as a felony.

She continued,

“Entertainers in LA need to know this is a justice system that will protect them. There is no question here that when someone is violently assaulted by another in possession of a deadly weapon that it should be charged as a felony.”

Isaiah Lee, 23–the man accused of attack Dave Chappelle while performing– was charged Thursday (May 5) with single misdemeanor counts of battery, possession of a weapon with intent to assault, unauthorized access to the stage area during a performance and commission of an act that delays an event or interferes with a performer. He appeared in court Tuesday for a bail review hearing at which the judge denied a request to have Lee’s bail reduced. He will remain in jail with bail set at $30,000.

According to reports, if Lee posts bond and is released from custody, he will have to remain at least 100 yards away from Dave Chappelle, the Hollywood Bowl and any venue where Chappelle is performing.

As previously reported, Dave Chappelle was performing at the Hollywood Bowl last week as part of the Netflix Is a Joke comedy festival when a man ran up on stage and tackled him. The man then ran back stage, where security quickly tackled him.
Reportedly, the attacker was carrying a plastic replica gun containing a knife. The man was removed in an ambulance with a broken arm and swollen face after security subdued him. Police arrested the suspect hours later for assault with a deadly weapon. According to Isaiah Lee’s brother, he is homeless and struggles with mental illness.

Last Thursday (May 5), the Los Angeles County District Attorney’s Office announced that it would not file any felony charges against Isaiah Lee.

“After reviewing the evidence, prosecutors determined that while criminal conduct occurred, the evidence as presented did not constitute felony conduct.”

Isaiah Lee is due back in court May 20 after pleading not guilty to the four misdemeanor counts.
