[EXCLUSIVE] Rapper Fabolous Accused Of Theft, Sued For Causing Musician Anxiety & Depression
He continues by saying neither Fab or Def Jam reached out to him to try and get a license to use his music. Kelley says due to them stealing his music he has lost out of profits from the song he created. He says they were even bold enough to register the song claiming they were the writers of the music.
Kelley says they specifically took his music sped up the tempo, distorted and damaged the musical and vocal characteristics in an attempt to make sure nobody knew the song was stolen.
Further, he says that Fab’s actions have caused him mental and emotional harm. He says he has experienced distress, anxiety and depression. He claims Fab stole from him and he needs every penny to live since he is in retirement.
He also adds that his lawyer sent a letter to Def Jam and Fab but they never responded. Kelley is suing for money made from the song and to stop them from continuing to steal his music without paying him.

At first my thought was wth is this dude talking about? It’s a slow song. But right at the hook, it clearly sounds like the Fab song, just slower.

I may be wrong, but that song is from Soultape 2 which is a free mixtape. Fabolous doesn’t make money from directly from the sale of the mixtape. That’s why artists put songs with samples they can’t clear or are too expensive to clear on mixtapes. I don’t think there are any profits to lose out on. If it was on an album that was for sale that would be different. I don’t think he even performs the song at shows. I feel sorry for the man, but that seems to be standard practice right now. I doubt he’ll win anything.
Yes, you’re definitely right. Herman Kelley is going to lose as the mixtape were released free to the public. The Soul Collection that is being said is a CD version from the studio, Kila Records (Import) who took 20 songs off from the Soul Tape 1 & 2 and are selling it online. I don’t know if Fabolous or Def Jam are in contact with Kila Import, but if they are not you can see why Def Jam and Fabolous weren’t responding to the man as he wasn’t selling the tracks. It’s DefJam/Fab that should be suing Kila Records for making money off of Fab’s work but this is only if Kila and DefJam/Fab are not partners. Basically, Herman is suing the wrong party.
