Berry was also ordered to produce agreements where a donation was made to a charity in exchange for Plaintiff providing promotional, marketing or advertising-related services to the company/brand making the charitable donation.
According to the court docs, she had to provide all docs which explain
(1) whether Plaintiff wears merchandise gifted to her before giving it away to charity; and (2) Plaintiff’s understanding of the level of likelihood of her being photographed when outside her house.” Also, the company is allowed to ask her team of people about these questions.
Reportedly, on November 17th both parties filed docs in the case stating Berry would be awarded a permanent injunction against ToyWatch. According to the court docs, the company is now prohibited from using Berry’s image, likeness, image, voice, trademark or sound-alike voice in any advertisements, marketing or promotion — unless she gives them permission beforehand.
