(EXCLUSIVE) Rapper Fabolous Scores Legal Victory Against Musician Accusing Him of Stealing Music
Kelley stated they specifically took his music, sped up the tempo, distorted and damaged the musical and vocal characteristics in an attempt to make sure no one was aware that the song was stolen. Further, he accused Fab’s actions of causing him mental and emotional harm. He claimed that he experienced distress, anxiety and depression for the money he lost due to the rapper’s actions.
He said in his lawsuit that his lawyer sent a letter to Def Jam and Fab but they blew him off and never even responded. Kelley sued for all profits made from the infringing song and an injunction against them from continuing to sell the track.
Then on October 19th, the federal court judge came back with his decision and sided with Fabolous in the legal battle and dismissed the entire case and awarded the plaintiffs’ NOTHING from their complaint.
The judge notes that the plaintiffs did not prove they actually have ownership of the song they claim was stolen. He also shot down the claims of emotional distress claiming the man didn’t provide any evidence for his mental and emotional damage. The case was dismissed the same day.
