Update: Porsha Williams Warns Estranged Husband Simon Guobadia Not To Alter Or Destroy Any Financial Records Amid Their Divorce Or She’ll Have Him Sanctioned

Update: (Feb. 28, 2024): Porsha Williams has issued a firm warning to her soon-to-be ex-husband.

According to a report from RadarOnline, the reality TV star strongly urged Simon Guobadia in her divorce petition not to discard or alter any documentation related to their financial records during their divorce. The petition, which was filed in Georgia on February 22,  stated,

“After a petition for divorce has been filed, no transfer of property by either party, except a bona fide transfer in payment of preexisting debts, shall pass title so as to avoid the vesting thereof according to the final verdict of the jury in the case.”

And continued,

“Pending the final determination by the court of the right of either party to alimony, neither party shall make any substantial change in the assets of the parties’ estate except in the course of ordinary business affairs and except for bona fide transfers for value.” 

Porsha made it known that she was serious about her demands, stating she’d have her estranged spouse sanctioned should he violate her wishes,

“not to destroy, conceal, or alter any video, audio, paper, or electronic files or other data in connection with this pending litigation, including, but not limited to, any of the following items that are either presently in your possession or control, or which may come into your possession while this case is ongoing: any financial records or statements; all income records; all tax records; all expense records; all recordings or evidence reflecting relevant conduct by either party; any item that supports any defense raised by you to this complaint’ and/or any item which supports any claim made by you in any counterclaim or pleading filed in this matter.”

And added,

“You are further notified that a failure to comply with this notice may result in sanctions for any destruction or failures to preserve any such evidence, including without limitation adverse inferences against you at trial, as well as an award of expenses and attorney fees necessitate by such conduct.”

News recently broke that after 15 months of marriage, Porsha Williams filed for divorce from Nigerian businessman Simon Guobadia. Except for some online comments, both have been fairly quiet about their marriage ending. In fact, they’ve been so hushed about everything that some have alluded that the split was just a publicity stunt for Porsha Williams to gain attention ahead of her return to “RHOA.” However, a recent report from RadarOnline hints that not only is the divorce happening, but Porsha is very serious about ensuring her assets are protected as she returns to life as a single woman.

Before tying the knot, the former love birds signed a prenuptial agreement that Porsha is now demanding is enforced by the court. According to Porsha’s divorce petition, the prenup was signed on November 17, 2022, and “sets forth each party’s separate property interests and marital property interests.”

Simon Guobadia and his ex are currently “living in a bona fide state of separation,” per the petition. The legal document also argued Porsha was “entitled to a divorce from Husband on the grounds that the marriage is irretrievably broken … and there are no prospects for a reconciliation.”

The document added,

“Wife requests that said Prenuptial Agreement be enforced by this Court and be made a part of this Court’s Final Judgment and Decree of Divorce.”

The reality TV star’s lawyer also said,

“Wife is hopeful the parties will reach an agreement settling all issues pending between them; however, if such an agreement cannot be reached, Wife reserves the right to amend this Complaint accordingly.”

Porsha has asked that her estranged husband be ordered to pay her legal fees.
