Trump’s Birthright Citizenship Ban Ruled Unconstitutional By Appeals Court, Setting The Stage For Supreme Court Showdown
A federal appeals court has ruled that Donald Trump’s attempt to end birthright citizenship is unconstitutional. In a 2–1 decision issued Wednesday, the 9th U.S. Circuit Court of Appeals upheld a lower court’s order that had blocked the measure nationwide.
The case stems from an executive order issued during Trump’s presidency that sought to deny citizenship to children born in the U.S. to undocumented immigrants or temporary visitors. The policy was first halted by a federal judge in New Hampshire.
“The district court correctly concluded that the Executive Order’s proposed interpretation, denying citizenship to many persons born in the United States, is unconstitutional. We fully agree,” the majority wrote.
The ruling moves the contentious issue closer to a likely Supreme Court showdown.
Under the 14th Amendment, all persons born on U.S. soil are granted citizenship regardless of their parents’ immigration status. Trump’s order challenged that long-standing interpretation.
The 9th Circuit’s decision ensures the government remains barred from enforcing the order for now.
