Travis Scott – Legal Expert Says Some People Receiving Astroworld Refunds Could Be Waiving Right to Sue Organizers
According to a legal expert, people who are requesting to receive Astroworld refunds could be waiving their right to sue. Insider reports that within the Refund agreements, there is language that negates a concertgoer’s right to sue could be challenged.
As previously reported, Astroworld Festival is an annual music festival run by Travis Scott, held in Houston, Texas, at NRG Park.
On the first night of this year’s festival, a crowd crush occurred, resulting in the deaths of at least nine people and the cancellation of the second night of the festival. Over 300 people were treated for injuries at the festival related to the crowd crush.
Neama Rahmani, the president and a cofounder of the personal-injury firm West Coast Trial Lawyers, tells the outlet that concertgoers who accept a refund could be waiving their right to sue because they would be receiving something of value.
He explained,
“Courts generally uphold those types of waivers. The classic case is arbitration agreements. Everyone kind of scrolls through. No one reads the fine print, and guess what, you’ve waived your right to a jury trial, waived your right to file a lawsuit, to demand arbitration.”
However Dmitriy Shakhnevich, who is an adjunct assistant professor at the John Jay College of Criminal Justice disagrees. He says that he doesn’t think a refund agreement negating concertgoers’ right to sue festival organizers would be enforceable in court.
“If after an event that is traumatizing and that is difficult to overcome, you give somebody a refund for a ticket and sneak in some language in there, at the very least, that can be challenged in court in good faith,” Shakhnevich said.
