T.I. & Tiny Want Judge To Toss 2005 Sexual Assault Lawsuit, Argues The Statute Of Limitations On The Case Has Passed

Musical couple T.I. & Tiny Harris are seeking to have a sexual assault lawsuit against them thrown out.

Reports state that the pair recently filed a motion in the case, arguing that the statue of limitations have expired and that it should be “dismissed in its entirety.”

In the court document, reportedly filed Thursday (June 27th), T.I., real name Clifford Harris, 43, and his wife Tameka ‘Tiny’ Harris, 48, reportedly wrote:

“Here, at best, Plaintiff had up to December 31, 2007, to file the instant lawsuit based on the facts alleged in the Complaint…As such, this instant lawsuit, filed over sixteen years past that statutory deadline – 18 years after the facts alleged in the Complaint occurred is time-barred, along with all the claims asserted in the Complaint.”

 “there are no facts whatsoever that could redeem or revive any actionable claims by Plaintiff against Defendants based on the 2005 encounter alleged in the Complaint.”

The plaintiff filed the suit under California’s Sexual Abuse and Cover Up Accountability Act — which extends the statutes of limitations for sex abuse and assault victims to December 2026. She alleged  in the complaint that she:

“did not consent to any of the sexual assault or misconduct” 

Presently, the amount in damages Jane Doe is seeking has not been disclosed at this time. She is suing for sexual battery, battery, sexual assault, negligence, false imprisonment and intentional infliction of emotional distress, adding that the alleged assault “has prevented” her from “performing daily activities and obtaining the full enjoyment of life.” A hearing has reportedly been scheduled for T.I. and Tiny’s dismissal request Wednesday, August 7.
