An arrest warrant was later filed for one count of misdemeanor aggravated menacing. In court documents, authorities said Joe Mixon told the alleged victim at the time,
“You should be popped in the face, I should shoot you, the police can’t get me.”
The case was later dismissed on Friday (Feb. 3) after prosecutors said they needed
“additional investigation before we would move forward with this case.”
Hamilton County Judge Curt Kissinger said,
“I will sign the entry of dismissal. And the warrant will be recalled subject to further filing by the City of Cincinnati.”
Prosecutors said the alleged victim would like to still go forward with the charge “if we do decide to refile it.”
Following the court filing, Joe Mixon’s rep said in a statement the charge was “a rush to judgment.”
“I really feel that police have an obligation before they file charges – because of the damage that can be done to the person’s reputation–to do their work.”
Joe Mixon is a running back for the Cincinnati Bengals. He played college football at The University of Oklahoma, where he was a first-team All-Big 12, and was selected by the Bengals in the second round of the 2017 NFL Draft. Mixon received Pro Bowl honors in 2021 as a member of the team that played in Super Bowl LVI.
