Drake Scores $300k Victory in Lawsuit

theJasmineBRAND.com exclusively reports, Drake scored a huge victory when a federal judge sided with him this week in court, by dismissing a 3-year long battle with a famous jazz musician’s estate ordering that the rapper doesn’t owe $300k for a sample.

Here’s the latest: On May 30th, the federal court finally came back with his decision in the case. The judge – having heard the evidence and testimony – appears to still not know who exactly owns the copyright of Jimmy Smith, saying there is a genuine dispute of material fact as to ownership and copying of his music.

He explains the sample Drake used in his track is considered fair use and it doesn’t infringe on any copyright. Drake won’t have to pay the estate and the case has officially been closed.

Here’s the backstory: Back in 2014, the rapper was sued by the estate of jazz musician Jimmy Smith who accused Drake of illegally sampling the late musician’s 1982 song entitled, “Jimmy Smith Rap” on his track “Pound Cake/Paris Morton Music 2” which was featured on his album “Nothing Was The Same”.  The estate sued demanding $300k in damages for copyright infringement.

Drake responded to the allegations and accused the estate of not owning a valid copyright for Jimmy Smith’s track and therefore could not sue him for damages.  The parties have been battling it out in court for 3 years without any resolution.
