It’s Never Too Late for A Lawsuit! RHOA’s Kandi Burruss Sues Kim Zolciak Over ‘Tardy’ Song + VH1 Casts Role of Pebbles For TLC Biopic
Former semi-besties and RHOA cast mastes Kandi Burruss and Kim Zolciak-Biermann went from cocktails to the courthouse. Kandi is finally suing Kim for not properly compensating her for the three-year-old song, “Don’t Be Tardy For The Party.”
Earlier this week, Kandi and co-writer Rodney Richards filed paperwork in a Georgia court seeking:
Damages for copyright infringement due to Defendants’ unauthorized and unlawful licensing, distribution and sale of Plaintiffs’ creative works, namely a sound recording embodying a performance of a musical composition entitled ‘Tardy for the Party. ‘ “
Both Kim and oldest daughter Brielle (who received a song writing credit) took to Twitter to vent:
This was a major source of contention during season 3 which aired in 2011, when Kandi stated she was ONLY paid a one-time $4,000 fee, she also said:
Normally, I would get sync license fees every time the song plays, but I gave the show a gratis, I know Kim was new to the music industry so I don’t feel like she was purposely trying to wrong me. I just think she was misinformed.”
This week Kim told TooFab.com:
This is nothing short of a publicity stunt, I find this lawsuit funny yet sad. Coming after me now and this song is 4 years old? I have in fact overpaid Kandi and have documents to prove it and my legal team will handle this accordingly.”
The reunion show is taping this week and both ladies will be there. In another bit of news, Kandi is being represented by fellow cast mate Phaedra Parks. Kim’s spinoff, ‘Don’t Be Tardy’ and Kandi’s ‘The Kandi Factory’ air in April. In other news…
